Question: 1
Hiring a male
counselor at the women weight loss center is not a good idea especially when
the weight loss center can hire women as counselors. In this case, male sued
for the gender discrimination that can be tackled easily through the legal
process. According to the Exemption Application under the Sex Discrimination
Act (1984) institutes can get the exemption by the court as exercise centers
for women can only hire women to provide the safe environment (Humanitarianism, 2018). In accordance with
this Act, court decision will support the exercise center rather than the male
candidate. Exercise center is only for women therefore male cannot be recruited
there and it's not a gender discrimination.
Question: 4
Yes, the hiring
manager was discriminated in withdrawing the offer. Library of Congress just
rejected the Diane because of gender transitioning. They were going to Diane
when they were with the point of view that she is male named David (Aclu.org,
2008).
But when she told them the truth of gender transaction according to which she
was going to be a woman in future they rejected her and offered the job to male
with lower scores. It’s clearly a case of gender discrimination and rejecting a
person just because of the gender is quite unethical and illegal in the world.
Question: 5
In accordance
with the laws and regulation by the courts of country, the court will decide
the matter against the female bartender. The policy of the company was equal
for both genders. If they were asking women to be attractive, they asking men
also (Aclu.org, 2008). Therefore no
discrimination is made by the company. In fact, the reason of termination by
the company was strong as she denied the policies of the company and therefore
company could be terminated her on this basis even when she was a good employee
and performing better than the other female workers at the bar.
Question: 6
The court will
decide the matter in the favor of her. The company promoted women and rejected
the other one just because of sex-stereotyping. Rejecting a person because of
such reasons is considered sex- stereotyping. Such discrimination and
sex-stereotyping are just common in the societies. The decision of the three supervisors was
quite unethical and wrong in terms of laws and regulations for the promotions
and incentives established by courts of the country. while there are chances
that court take a different decision in case there are other factors or authentic reasons are involved in this
decision and company tell that reasons in investigation or court.
