It is vital that before any
documents of contract is signed, it is good to have good understanding of each
other duties. like in the contract work client should be aware of his
responsibilities that may fall under safety, welfare and Health at the work. (Construction)
Regulations, 2013. Secondly it should also address any changes that may occur while
the contractual work in going on. (Oluka and Basheka 2014).
Property
and Tort Law of Contract Management and Logistics
As compared to criminal law in
civil law the branches that deal with tort law and contract law have many same
things as well as many things that differ from each other. the characteristics that
corelate to each other refer to the damage done within the tort cases and contract.
To make it simple this law is
implemented to those who were in some sort of agreement. Further if any of the
party in this contract fails to oblige is due duty as illustrated in the
contract, law will try to help the party with damage. Mostly the damages are given back with aim to
help the damage party to restore the state where they were before the contract
was beaked or may be according to the stipulations cited within the contract. If we talk about tort law, according to this
law each member of the community is anticipated to well behave with each other.
it is based on the principle that people are responsible for actions they have
done. Additionally, it can be seen as if
any action of any person results in the injury of other person, the person will
be held responsible based on the fact that either his actions were due to any
accident or as a result of deliberate act. With the aim to pay for the injured
person damages. In some situations, tort
law and contract law both laws will be incorporated within the same lawsuit,
despite the fact that both laws have differentiation but you will rarely see
any case where both law suits are filed separately. As if there is a case you
have in which there is any clause not fulfilled as the contract there will be
tort law that will be applied to compensate the damages. (Selviaridis 2015).
