This fraud law was come into being in 2007
in England and also in Northern Ireland. There are some following offences
about this fraud law and these include section 15 in which there is discussion
about that property that has been obtained through deception, then after this
in the next section 15A there is discussion about the transfer of money through
the help of deception. The section 16 of the fraud law will be used when the
employee gained financial advantage through the help of deception. After this
in section 20(2) this act will be implemented when the employee wanted to gain
valuable security in the company through the help of deception (Aylott, 2014). There are some
thefts laws that are in the act of 1978 and these include section one and
section two. The section one act will be implemented when the employee obtain
services through the help of deception and section two act will be used when
evasion of liability occurred through the help of deception. These all are the
legal statements for the employment fraud in any organization (Dorrell & Gadawski,
2012).
Gross Misconduct and Maternity of Legal Aspect of Business
According to the law it is not legal to fire
the employee who is pregnant, in the given scenario the suspect Jane is
pregnant and Adam has also not single evidence against her regarding the fraud
or loss of money. According to the section of law if the owner of the
organization fired the pregnant lady so that lady can charged the owner due to
this act. According to the lawyer park
he said that you can get fired during pregnancy but there are some limitations
in these acts. Parks explains in the light of this act the owner cannot fire an
employee when she is on parental leave but they can fire the employee if she
has misconduct in the organization and she is on pregnancy leave (Benny, et al., 2012).
If the owner has some issues with the
employee like if the employee misconduct in the organization so the owner has
the right to blame its employee. The next important point is that if he has
doubt on his employee so that he must has to collect evidences according to his
doubt. The owner of the organization has the right that he can fire the
employee when anything against him has been proved with effective evidence so
if that person is who is fired from the organization and she is at parental
vacations so that she can charged the owner of the organization against this
action (Clifford, 2014).
