Regulation of public office forms
the base of every other law and is the most important part of our legal system.
What are the duties and practices of the legislative or the people who make
law, is very important and needs to be discussed. Administrative law is the
field discussing these questions, and in the UK, it is done for deciding and
regulating the processes and status of public bodies. Full control of the
parliament in the UK is an important question. To what extent is parliament free?
Ever since the fall of monarchy in the UK, the parliament has strengthened a
lot. The key question is whether or not parliament should be able to make any
kind of laws, and if it is legally entitled to this right or not. [1].
One of the ways to regular our
public body is through the judiciary. This process happens through a judicial
review and proceeds accordingly. When a public body passes a legislature,
someone can apply to a High Court if they have well enough credentials against
the decision of the public body. This
must be done, however, within a time of 90 days. The reasons for a review could
be the illegality or power abuse of the decision, or it could be due to a bias
in the decision. Decisions can also be challenged on human rights grounds,
irrelevancy, or unreasonable judgment.
