To facilitate the general public
government of England has established a system through which people can appeal
against the decisions of the different public departments. This review system
has enabled the public to easily request to the court to review the decision,
which they thought are biased or unfair. The high court has launched a special
branch called administrative court, which deals with all the applications for
the review of the decisions of the public departments. Administrative court cannot
only change the decision of the public department but it can also pay the
losses to concern person and impose fine on the public departments if they make
any biased or unfair decision. [6].
In England, whenever a public
body or public department is formed then all the authorities and powers and
SOPs are defined for this public body according to the law. Whenever any matter
is put forward to the administrative court for review against any public body,
then the court reviews this decision according to power and SOPs allotted to
the public department by law. In addition, court analyzes the decision if
public body has made the decision by keeping these legal boundaries under
consideration. European convention on human rights has been followed in
England [4].
In USA and some other countries,
some laws, which are made by the parliaments, can also be reviewed by the
courts. However, in England laws made by the parliament cannot be reviewed by
the court except few of those laws, which are against the European Convention
on Human Rights, and European Union laws.
