Discuss the Tort of Negligence. What are the elements of negligence – the defenses that can be raised in negligence suits?

The tort of negligence means that an individual have suffered loss or harm because another individual did not take proper care. It means that due to the negligence of the person the other person face significant loss. Mainly the loss is occurred between such parties who does not have any contract between them. The key elements of negligence are:

·         Duty of care

·         Breach of duty of care

·         Loss due to breach

The defenses that can be raised in negligence suit include voluntary acceptance of the risk and contributory negligence.

 Discuss products liability law. In your answer identify and briefly at least three situations in which there would be ground for holding g a manufacturer liable for a consumer’s injury or illness.

The product liability law included the rules & regulations which determine which party is responsible for the dangerous & defective products. The product law is different from basic injury law. The manufacturer will held responsible for injury if defect occurs at the time of manufacturing. If the defect occurs during installation or assemble than it would be the fault of manufacturer.

 Identify and discuss at least three intentional torts

Intentional tort is a type of tort law. It occurs when an individual purposely harm or damage another individual or its property. Following are three types of intentional tort:

·         Fraud

·         Trespass (property or land)

·         Assault

Fraud including deceiving another individual for personal or financial gain. Trespassing means entering into the property of a person without permission and assault means physical attacking on another individual.

 Identify and discuss changes in tort law over the years

The tort law have changed over the years and many amendments have been made by keeping different scenarios in mind. The word tort first used in the year 1580s. In the medieval period several changes in the tort law occur. After that tort law has experienced English and United States Influence. Modern tort become influenced by insurance law.
