There
are many laws that are charged against a person who is involved in any criminal
activity. For in this case Mike was the main villain as he has been involved in
the criminal activities. First, he uses the fake currency to pay the price of
the ring which he has bought for Tina. Secondly, he used a gun to shoot a
person and he killed him. Thirdly he forced Tina to go with him and has
forcefully taken her to his friend’s apartment. There he put the gun on Tina
and wanted to kill her too but then his friend Tony came in front of Mike and
stopped him but Tina was afraid of Mike and Mike threat her to shoot her, Tina
was so afraid that she fell down from the window and died at the spot and Mike
hit the gun over the Tony’s head and he became unconscious. As well as he has
done a robbery as well by roberring the Tony’s phone and cash.
According to the
Model Panel Code, Mike will be charged with Robbery, Counterfeit, Coercion of
political activity and second degree murder.
For the second
degree murder offense level 38: 19-250 the punishment will be life without
parole or any other term.
The penalty for
counterfeit according to the Model Panel Code is to charge money up to $15,000
from the criminal or in other cases 15 year for prison.
For
intimidating, threatening, commanding or coercing a person, the criminal is
punished by fine or he will be prisoned for three years.
For robbery, U.S
Code Title 18 is used and 15 years of imprisonment is given to the person.
These are the
charges that are against Mike but there is also a charge against Tony because
he had the Counterfeit Money and he will also be charged. The penalty for counterfeit
according to the Model Panel of Code is to charge up to $15,000 from the
criminal or the person that has made a scam or imprisonment of 15 years will be
given to the criminal.
The defense
shield against counterfeit that Mike and Tony can use according to the Model
Panel Code is that they can see they are not guilty because they did not have
any intention of fraud or they both can defend themselves by saying that the
quality of the currency is low that it does not fulfill the definition of the counterfeit.
The robbery
defendant can say that they had not been present there at the time of robbery,
they were attending some event, they can change the eye witnesses by paying
them money or they can simply refuse that they were not involved in any theft
because they were out of city at that time and can show them some fake witnesses.
But they can only defend themselves on that condition if they are not caught
red handed.
Defense against threatening
can be that they are just being harsh for some time or they are just acting
harsh or they are just trying to keep the person with them by faking the
threat.
But in most of
the cases there is no defense against murder when you have did it in front of
everyone.
