Alice Johnson, the CEO of CyberTech forensic cybersecurity law firm, has asked for expert advice regarding an International hacking lawsuit.  The firm represents Equation Set, who is US based and a suspect attempt to hack in the Office of Personnel Management team. Also, represent Anomalous a non-US grey hat hacking group was suspected of hacking into the computers of the Office of Personnel Management (OPM).  However, it turns out that Equation set hacked the Office of Personnel Management (OPM) in the year 2015.  This creates a potential conflict of interest because of testifying on behave of its clients.  In order to determine the best course of action, CyberTech must carefully consider before deciding to continue representing Anomalous while still representing the Equation set.  In the case of CyberTech, representing both clients present legal and moral complications because of the OPM hack millions of government employees.  However, as long as the firm fully discloses with both clients and ensures the US government can trust and compromised its employees, they can retain both clients and maintain its image an unbiased cybersecurity consulting firm.    

1.      Explanation of Issue of CyberTech

CyberTech, a cyber security consulting firm, handling two cases regarding an international lawsuit hacking on Office of Personal Management (OPM) from the year 2015.

Case 1, Anomalous grey hat hacking group was suspected of hacking into the computers of the Office of Personnel Management (OPM).

Case 2, Anomalous suspected in the OPM breach, is claiming that US-based Equation Set attempted to hack its facilities.

So this analytic paper will focus on how CyberTech with the involvement of this both lawsuit cases will manage if there are any conflicts from testifying on behave of his clients, or how could affect if the company become aware of by others.  During this report of analysis, I will cover issues around OPM hack and suspicious activities; On the other hand, if CyberTech supports his client Anomalous against Equation Set affected by OPM breach alternative viewpoints and solutions will be provided. 

2.      Analysis of the Information of CyberTech

In order to analyze the information, CyberTech must first identify the assumptions and possible biases that may affect the decision-making process.  The first case is Anomalous a non-US grey hat hacking group was suspected of hacking into the computers of the Office of Personnel Management (OPM). But until the full analysis, CyberTech cannot conclude the response case.  Also should be aware of possibilities of conflict of interest that may happen Anomalous be found responsible for the OPM hack to ensure an unbiased analysis CyberTech must enter the analysis process without predetermined assumption so it may affect the result.  Also on the other case how will CyberTech organize the case in order to properly assist both sides to gain or loss of the case with the risks. 

CyberTech also considers bias if Anomalous is suspected to involve on the hack, it should also compromise the OPM employees well being in danger.  On the other hand of representing the gray hot hacking group, the suspect breach adds some tensions with the OPM employee victims too. 

3.      Consideration of alternative viewpoints and conclusions of CyberTech

In the alternative viewpoints CyberTech will have three options to choose, the first option is moving forward only one case, the second is running both cases and last is leaving both cases alone.  On the first option forwarding only with one case CYberTech will lose a client for the future and can’t be loyal for the other also hurt the lawsuit. 

If they forwarding both cases at the same time, there will be a problem such as damaging the company’s reputation also the employees will be losing an interest who has conflicting cases but will be hard to work further with the company in trusting issue.  The last and best alternative option will be to not represent any of the client’s cases. This strategy will help save future clients will also save the company’s reputation.

4.      Conclusions and Recommendations of CyberTech

To conclude, CyberTech best option in this situation is to must carefully consider deciding if there is any conflict of interest consulting of Office of Personnel Management (OPM) which victim of cyber hack of all the employees, also on other hand Anomalous grey hat hacking group suspects the US-based company Equation Set attempted to hack its facilities.  Although the CyberTech can also move forward to represent both companies with must disclose their information without any conflict and last option CyberTech must drop Anomalous as a client in order to maintain its reputation.
